N.Y. Insurance Superintendent Mills Warns Insurers Against Canceling Policies
The New York Insurance Superintendent Howard Mills is taking steps to reign in potential cancellations of homeowners’ policies in various New York counties.  According to nationalunderwriter.com Mills wrote insurers “urging them not to act hastily and cancel the insurance of homeowners in flood-hit areas, while reminding carriers he has the power to halt policy terminations… In particular, I would hope adjusters and underwriters exercise care and responsible judgment in making determinations regarding claims, cancellations and non-renewals of policies.”

The strong Circular Letter was sent to insurance licensees in the flood-affected areas, 13 counties where Gov. George Pataki declared a disaster emergency.  Heavy rains caused the flooding two weeks ago along the Susquehanna River by New York’s southern tier as well as by the Delaware River on the state’s Western edge. 


There is a New York insurance law allowing the superintendent to “declare a moratorium precluding policy cancellations and non-renewals in areas of the state that have received a disaster or catastrophe state of emergency declaration from the governor.”


If I were living in a flood-affected area I would be none to happy if my homeowners policy was cancelled.   At least wait until the area is no longer called a disaster emergency.
