New York Senate Passes Auto Insurance Fraud Legislation
In an article on NorthCountyGazette.org New York insurance fraud is “costing New Yorkers more than one billion dollars a year.”  Because of this staggering number legislation has just passed through the New York State Senate and onto the Assembly that will combat auto insurance fraud.  Senate Majority Leader Joseph L. Bruno said “It's estimated that as many as one-third of all auto insurance claims contain some element of fraud, which is a major reason why auto rates in New York are among the highest in the country.”

Some of the provisions included in the legislation are:



  • cut in half the value of property obtained through a fraudulent   insurance act in order to be convicted of insurance fraud;
  • Crack down on repeat offenders by establishing three levels of the crime of aggravated insurance fraud for people who commit fraud more than once in a five year period;
  • Allow district attorneys to prosecute organized auto fraud rings under the State Organized Crime Control Act, which carries tough criminal penalties.

I am floored by the sheer amount of auto insurance fraud in New York.  A lot of people are trying to pull the wool over the eyes of insurance companies.  Apparently enough are getting away with it to warrant this legislation.
